Terms of Service
Last updated
These Terms of Service ("Terms") apply to your use of AppZad, a hospital management service (the "Service"), and of this website. "We" and "us" mean AppZad. "Organization" means the hospital or clinic whose records are kept in the Service.
1. Acceptance
By signing in to or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you agree to them on that organization's behalf and confirm that you are allowed to do so. If you do not agree, do not use the Service.
2. Account usage
Accounts are created by invitation. You are responsible for what happens under your account and for keeping access to your email and sign-in codes to yourself. Do not share an account between people. Tell us at once if you think someone else has used your account.
3. Organization responsibility
The organization is responsible for:
- the accuracy and lawfulness of the information its staff enter into the Service;
- having the right to record its patients' information, including any consent or notice the law requires;
- deciding who is given access, and removing access when a person leaves or no longer needs it;
- keeping its own copies of any records it is required by law to retain.
4. Authorized users
Only people an organization's administrator has invited may use the Service for that organization. Every person with active access can view and edit all of that organization's records in the Service, so invite only staff who need that access. The organization is responsible for the actions of the people it invites.
5. Appropriate use
You agree not to:
- use the Service for anything unlawful, or to store information you have no right to hold;
- try to access another organization's records or another person's account;
- interfere with the Service, test it for weaknesses without our written permission, or get around its access controls;
- copy, resell or provide the Service to others except as we have agreed in writing.
6. Healthcare professional responsibility
AppZad is a tool for keeping records and running a hospital's daily administration. It does not give medical advice and is not a substitute for professional judgement.
Doctors and other staff remain fully responsible for diagnosis, treatment, prescriptions and every other clinical decision. The Service records what is typed into it. It does not check a prescription for correctness, dose, interactions or suitability for a patient. Check every prescription and printed document before it is given to a patient.
7. Service availability
We work to keep the Service available, but we do not promise that it will be uninterrupted or free of errors. The Service may be unavailable during maintenance, or because of problems with the providers we depend on or with your own internet connection. Organizations should have a way to keep working, for example on paper, when the Service cannot be reached.
8. Intellectual property
We own the Service, including its software, design and the AppZad name. These Terms give you a right to use the Service while they apply to you, and nothing more. The information an organization enters into the Service remains that organization's.
9. Data responsibility
The organization controls the information it enters into the Service. We handle that information to provide the Service, as described in our Privacy Policy. The organization is responsible for meeting the legal obligations that apply to it as the holder of its patients' records.
10. Limitation of liability
The Service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties about the Service, whether express or implied.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of data, loss of profit or revenue, or any clinical outcome, arising from the use of the Service or from not being able to use it. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
An organization may stop using the Service at any time. We may suspend or end access to the Service if these Terms are broken, if using the Service puts other organizations or the Service at risk, or if the law requires it. When access ends, an organization may ask us for its records to be deleted, as described in the Privacy Policy.
12. Changes
We may change these Terms as the Service changes. When we do, we will change the "Last updated" date at the top of this page. Using the Service after a change takes effect means you accept the new Terms.
